Most sustained protests turn on something an agency failed to write down. This one turns on something an agency wrote down twice, in the same evaluation, in two ways that cannot both be true.
DAS Federal, LLC of Gaithersburg, Maryland protested the award of a Centers for Medicare and Medicaid Services task order to Precise Federal Contracting LLC. Both firms are small businesses. GAO sustained the protest on two independent grounds, and the second one is the sort of finding that should be printed and taped above every source selection board in the country.
What Was Being Bought
RFQ No. 75FCMC26Q0023, issued by CMS, for hosting, operation and maintenance of the agency's integrated learning management system supporting the Integrated Surveyor Training Program. That is the training pipeline for the people who inspect health care facilities, so the underlying work is not glamorous and it is not optional.
Precise quoted 52,312,038 dollars. DAS quoted 49,160,762. The award went to the higher price on a best value tradeoff, which is entirely permissible when the technical difference justifies it. The question in every case like this is whether the technical difference was real.
Ground One: Grading An Answer Nobody Asked For
The corporate experience factor asked vendors to describe similar past experience. DAS described similar past experience. CMS then assessed weaknesses because DAS had not included a formal risk matrix, probability and impact scoring, or mitigation strategies specific to the Integrated Surveyor Training Program.
None of that was requested. The solicitation asked what the firm had done, not what the firm proposed to do. GAO put it plainly.
The agency also faulted DAS for not showing explicit alignment with program specific key performance indicators, in a section where vendors were never told to propose metrics at all. That is the definition of an unstated evaluation criterion, and it is one of the oldest sustained grounds in the book.
The practical lesson for anyone quoting is uncomfortable rather than useful: following the instructions exactly is what got DAS marked down. The remedy is not to guess and over answer, it is to protest, and DAS did.
Ground Two: Twelve Strengths And No Benefits
On the solution narrative factor the agency documented twelve strengths and zero weaknesses in the DAS quotation. Five of those strengths were written up as specifically benefiting CMS. The rating assigned was some confidence, and the supporting narrative concluded that the DAS quotation yielded no benefits or improvements to the baseline requirements.
Read those two sentences next to each other again. Five documented benefits, and no benefits. GAO did not accept the reconciliation the agency offered because the agency did not offer one.
This is not a technicality. An adjectival rating is a summary of the findings underneath it, and when the summary contradicts the findings the rating stops carrying any information. A source selection authority reading some confidence has no way to know it sits on top of twelve strengths and nothing else.
Why The Price Made It Prejudicial
Errors alone do not sustain a protest. GAO also has to find competitive prejudice, meaning a reasonable possibility that the protester would have had a substantial chance of award but for the error.
Here the arithmetic did that work. DAS was 3,151,276 dollars cheaper, a little over six percent below the awardee. In a best value tradeoff, an evaluation that strips a lower priced quotation of weaknesses it never earned and benefits it demonstrably did earn is exactly the kind of error that changes the tradeoff. GAO found the prejudice and moved on.
What CMS Has To Do Now
The recommendation is the standard package and it is not cheap for the agency. Reevaluate every quotation. Conduct and document a new best value tradeoff. Prepare a revised source selection decision. Reimburse DAS its reasonable protest costs including attorneys fees under 4 C.F.R. 21.8(d)(1), with the certified claim due within 60 days.
Note what is not in there. GAO did not direct award to DAS and it never does. The remedy for a broken evaluation is a correct evaluation, which can land in the same place. What the protester buys is a second look conducted against the criteria that were actually published.
The Part Small Firms Should Take Away
Two firms in this procurement are small businesses, which means nothing here turned on size status, set aside rules or the rule of two. It turned on evaluation discipline, and that is a reminder worth sitting with: the protests that get sustained are usually not the ones about who deserved to win. They are about whether the paperwork holds together.
So read your debriefing for internal contradictions before you read it for unfairness. A strength that appears in the findings and vanishes in the conclusion is a sustained protest sitting in plain sight. A rating that does not match its own supporting narrative is another. Neither requires proving that your quotation was better, only that the document explaining why it was not cannot be squared with itself.
